1. All prices are quoted excluding plinths unless specifically stated otherwise. Plinths may be available for an additional charge.
2. All prices quoted are based on the Purchaser collecting the sculpture from the venue at which it is held/exhibited. Alternative arrangements, including delivery by the Artist, or a person designated by the Artist, or delivery by courier can be discussed with the artist, but may incur additional costs, which will be agreed in advance with the Purchaser.
3. Payment by whatever means must be cleared within the time-scale agreed with the Artist before the sculpture/s can be removed by/sent to the Purchaser.
4. Deposits paid to secure the purchase of a sculpture must be cleared before the sculpture/s will be formally reserved. Deposits will not normally be refundable unless the artist has agreed special terms. The outstanding balance must be paid and cleared within the time-scale agreed with the Artist before the sculpture is collected/delivered.
5. Risk of damage to the sculpture/s will transfer to the Purchaser on collection/delivery.
6. The Artist does not accept any responsibility for late delivery due to strikes, lockouts, inclement weather or other problems arising from problems outside the Artist's control.
7. The Artist shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, failure to follow the Artist's recommendations however given, misuse or alteration of articles or damage caused by inclement weather or animals or insects.
8. It is the Purchaser’s sole responsibility to erect and install the sculpture/s and to attend to all aspects of such installation, and the Purchaser indemnifies the Artist against all claims of any nature arising out of damage to persons or property caused in any way by any article. Any advice or any assistance which the Artist may give, is given without prejudice to the aforegoing provision and without assumption of liability or responsibility in any respect.
9. The Artist will use his best endeavours to ensure that the articles will correspond with any material aspect of any specification given to the Purchaser, and that the final products are free of defects of material or workmanship, but makes no warranty with regard to the products or materials.
10. Special moulds or other items made for the construction of any article supplied to a Purchaser, remain the property of the Artist unless the contrary is expressly stipulated.
11. The articles sold are artistic products, and the Artist retains the intellectual property rights, copyright and design right in all articles sold by him, which may not be reproduced or copied in any form notwithstanding the fact that they have become the property of the Purchaser in terms of an agreement of sale, or otherwise.
12. In the case of editions, every effort will be made by the Artist to ensure that the supplied sculpture is as identical as possible to the sculpture as viewed by the Purchaser unless changes have been agreed with the Artist. However, the production process means that very minor differences, for example in patination, between editions may be be present.
13. Where a copy from an edition is displayed, that copy will, unless otherwise stated, normally be available for collection/delivery by the first Purchaser once the event at which it is seen closes. Further copies will be available on a time-scale agreed with the Artist.
14. Apart from a copy potentially retained by the Artist for personal purposes, once the stated number of editions have been sold, no further copies will be made and the mould from which they were made will be permanently destroyed.
15. Some editions may include unique elements. For example, stone plinths. In this event, the unique element will be chosen to be as similar as possible to that viewed by the Purchaser unless an alternative has been agreed in advance with the Purchaser, but an identical element cannot be guaranteed.
